General Terms and Conditions of Sale and Use

The company nana'selections, with its registered office at 2 rue Kneppchen, L-8234 Mamer, Luxembourg, telephone +352 621 180 004, registered in the Luxembourg Trade Register A43098, creates, designs, and markets articles within the European Union. Upon request, Nana'selections may, however, consider delivery to a non-EU country.

The offer and sale of articles on the Nana'selections Webshop to the customer, defined as the webshop user, are governed by the General Terms and Conditions of Sale set out below, which specify, in particular, the conditions for ordering, payment, delivery, and management of any returns of ordered articles.

Article 1. COMMERCIAL POLICY

Nana'selections sells articles directly on the webshop and conducts its own e-commerce activity exclusively with end-users, who are consumer customers.
By "consumer", Nana'selections means any natural person, capable and of legal age, i.e. having reached the legal majority and not subject to guardianship or curatorship, who acts for purposes unrelated to any business or professional activity.
Given the commercial policy described above, Nana'selections reserves the right not to process orders from persons who do not meet the definition of a consumer or orders that do not comply with its commercial policy.
These General Terms and Conditions of Sale exclusively govern the offer and acceptance of product purchase orders, as well as payment, delivery, and any returns of articles ordered by the customer on the Nana'selections Webshop.
By choosing to purchase articles from the Nana'selections webshop, the customer expressly and irrevocably accepts the terms of Nana'selections General Terms and Conditions of Sale.
These General Terms and Conditions of Sale shall prevail over all other particular general conditions not expressly approved by Nana'selections.
Nana'selections reserves the right to modify its General Terms and Conditions of Sale. The applicable conditions will be those in force on the date of the order placed by the customer.

Article 2. CHARACTERISTICS OF THE ARTICLES OFFERED

The articles offered are those featured in the Nana'selections Webshop.

Each article is accompanied by a description prepared by Nana'selections, which the customer can access by simply clicking on the article.

The photographs and descriptions of the articles are as accurate as possible but cannot guarantee a perfect similarity with the article offered, especially concerning colours.

Any discrepancies or errors, particularly technical or typographical, that may have been introduced will in no case engage Nana'selections's liability or give the customer the right to claim.

Article 3. ORDER PLACEMENT METHOD

3.1 The language available for concluding the contract is French.

3.2 To conclude a purchase contract for one or more articles in the Webshop, the customer must:

(a) Fill in the identification form electronically, on which they will provide all requested details.

(b) Validate their order after checking it and correcting any errors.

(c) Pay for their order online using the methods offered on the webshop.

3.3 Order confirmation implies acceptance of these General Terms and Conditions of Sale (also referred to by a hyperlink, including the Privacy Policy), acknowledgement of having perfect knowledge thereof, and waiver of any other terms and conditions.

All data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out.

Article 4. ORDER REGISTRATION

To allow the customer to review their order before definitively validating it, Nana'selections offers order registration in 3 steps: shopping cart validation, entry of delivery information, and payment of the order.

After this final validation, the order is considered irrevocable and can only be challenged under the conditions defined below.

The order form will be archived in Nana'selections database for the time necessary to ship the order and in compliance with legal deadlines.

The customer can access their order form upon simple request in the webshop with their customer account references.

Article 5. ORDER CONFIRMATION

For any order placed, if Nana'selections is unable to ship all items within 5 working days of the order being placed, you will be informed by email of the best possible delivery times.

If this timeframe does not suit you, you will then have the option to cancel all or part of your order, within 24 hours of receiving the email confirming the possible delivery date, by returning it to us and specifying in your cancellation request the list of items you do not wish to receive.

In this case, no charge will be made to your account, or only for the value of the remaining items to be delivered in your order. A summary email of your purchases will be sent to you again.

Otherwise, we will consider that you validate your order in accordance with the proposed deadlines. Your order will then be processed and your account will be debited.

Nana'selections incurs no liability in the event of stock shortage or unavailability of products.

By keeping this email and/or printing it, the customer has proof of the order that Nana'selections recommends them to keep.

Article 6. SELLING PRICE

The selling prices of the articles are expressed in euros, all taxes included, excluding delivery costs.

Any delivery costs indicated in Article 10 below are the responsibility of the customer and are invoiced in addition to the selling price of the articles.

The prices of articles may change at any time. The selling price retained for the purchase of each article corresponds to that observed on the webshop at the time the order was registered, except for typographical error.

Any change in the value-added tax (VAT) rate will be immediately reflected in the selling price of the articles.

Article 7. PAYMENT METHODS AND INVOICING

7.1 All purchases made on the webshop are payable upon order.

7.2 Payment must be made in euros.

7.3 The payment method accepted by Nana'selections for the settlement of purchases is via PayPal (PayPal payment or credit card payment via PayPal) or by credit cards via Stripe Payments Europe LTD.

Your credit card is only debited when your order is registered. In case of unavailability of certain ordered items, only the price and shipping costs related to the available products will be debited.

(a) At the time of payment via PayPal or Stripe, the customer must enter their credit card number, its expiry date, and the last three digits on the back of the credit card in the fields provided for this purpose. The entry of this information is secured by PayPal or Stripe.

(b) This information will never be used by Nana'selections for purposes other than completing procedures related to the customer's purchase, making any refunds in the event of returns of articles, or reporting the occurrence of fraud on the Webshop to the competent authorities.

(c) Nana'selections reserves the right to suspend any order processing and delivery in the event of refusal of payment authorization.

7.4 Nana'selections reserves the right to refuse to make a delivery or to honour an order placed by a customer who has not paid for a previous order in full or in part, or with whom a payment dispute is ongoing.

7.5 Nana'selections reserves the right to prosecute any use or attempted use of fraudulent payment methods.

Article 8. DELIVERY MODALITIES

Delivery is made to the address indicated by the customer on the order form, which can only be within the geographical delivery area.

The Geographical Delivery Zone is the European Union.

Delivery is carried out by carrier.

In the event of the Customer's absence during delivery, a delivery notice will be left in their mailbox informing them of the delivery service's visit and inviting them to collect their package from the carrier.

Delivery is considered completed on the date of the first presentation of the ordered item(s) in its package at the delivery address indicated by the customer on the order form.

The ordered item(s) will be handed over against the customer's signature on a delivery note.

The customer is required to check the condition of the packaging and the conformity of the delivered item(s) before signing the delivery note. Any defect or non-conformity concerning the delivery such as, for example, damage, missing or damaged item, must be imperatively indicated on the delivery note and signed by the customer.

The customer must confirm the detected defect or non-conformity by sending a registered letter with acknowledgement of receipt outlining the observed defect or non-conformity to the carrier, with a copy to Nana'selections, within fifteen (15) working days from the date of delivery of the item(s) to the customer.

In the absence of a complaint made within the aforementioned period, the delivered item(s) will be deemed compliant and free of defects and accepted by the customer.

No defective or non-compliant item may be exchanged before it has been returned and received by Nana'selections, in good condition, as delivered by the carrier and in its original packaging.

Article 9. DELIVERY

Delivery times are indicative.

In the event of Nana'selections's inability to deliver within the indicated deadlines, the Customer will be offered a refund of their purchase or a replacement item of equivalent value.

In case of delay in delivery, Nana'selections cannot be held liable, for whatever reason, and no claim for compensation, of any kind whatsoever, can be made by the customer against Nana'selections.

Article 10. DELIVERY CHARGES

Delivery charges are indicated on the website, and their cost for a specific order is displayed when the order is registered. They include packaging, handling, and postal fees.

Article 11. RETURNS

The customer benefits from a withdrawal period of fifteen (15) days from the delivery of the order placed on the Webshop.

During this period, the customer may return, at their own expense and without further penalty, any item(s) that do not suit them.

Such a return will only be accepted by Nana'selections if:

(a) The customer has, before any return of one or more articles, imperatively contacted Nana'selections.

(b) The returned article(s) must not have been used, modified, washed, or damaged.

(c) The returned article(s) are still in their original packaging.

(d) The returned items are sent in a single shipment.

Soaps and room fragrances are not eligible for return or exchange.

Nana'selections reserves the right not to accept items from the same order, returned and shipped at different times.

If this right of withdrawal is exercised under the conditions defined above, Nana'selections will do what is necessary to refund any sums already collected in exchange for the returned articles, excluding their delivery costs.

Any sums collected will be refunded as soon as possible and in any case, within thirty (30) working days following the date on which Nana'selections became aware of the customer's exercise of the right of withdrawal, regardless of the payment method used.

In the event that the conditions for exercising the right of withdrawal described above have not been met, the customer may, at their own expense, re-obtain the articles returned to Nana'selections in the condition in which they were returned to Nana'selections.

Article 13. RETENTION OF TITLE AND TRANSFER OF RISKS

NANA'SELECTIONS EXPRESSLY RETAINS OWNERSHIP OF THE DELIVERED ARTICLE(S) UNTIL FULL PAYMENT OF THE PRICE, INCLUDING PRINCIPAL AND INTEREST.
The simple delivery of payment instruments does not constitute payment.

In the event of the customer's failure to fulfil their payment obligations, for whatever reason, Nana'selections will be entitled to demand the immediate return of the delivered item(s) at the sole expense of the customer.

The above provisions do not prevent the transfer of risks of loss or damage to the customer. The risks of loss or damage are borne by the customer from the moment the products have left Nana'selections's premises.

Article 14. FORCE MAJEURE

Nana'selections shall not be held liable for any breach of its contractual obligations in the event of force majeure or unforeseen circumstances, such as, in particular, disasters, fire, internal or external strikes, internal or external failures or breakdowns, and generally any external, unforeseeable, and irresistible event preventing the proper execution of orders.

Article 15. WEBSITE USE

All elements of the Nana'selections site are and remain the intellectual and exclusive property of Nana'selections.

No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual, or sound.

Any simple or hypertext link is strictly forbidden without the express written consent of Nana'selections.

Nana'selections, in the online sales process, is bound only by an obligation of means; its responsibility cannot be engaged for damages resulting from the use of the internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

Article 16. PERSONAL DATA, PRIVACY POLICY

In accordance with the Luxembourg law of August 2, 2002, concerning the protection of individuals with regard to the processing of personal data, as amended, information relating to customers may be subject to automated processing.

Customers have a right to access, rectify, and delete data concerning them, in accordance with this law.

Nana'selections reserves the right to collect information on customers, including by using cookies, and undertakes not to communicate its customers' contact details to third parties without the customers' authorization, with the exception of third parties involved in the execution of orders (carriers, banking services, etc.).

In the exceptional case of non-payment or payment fraud, Nana'selections reserves the right to communicate all necessary data to the police services, competent jurisdictions, and collection agencies.

Article 17. ARCHIVING-PROOF

Nana'selections will archive order forms and invoices on a reliable and durable medium constituting a faithful copy.

The computerized records of Nana'selections will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Article 18. APPLICABLE LAW AND DISPUTE RESOLUTION

These General Terms and Conditions of Sale are governed by Luxembourg law.

Any related dispute falls within the exclusive jurisdiction of the courts of the city of Luxembourg, without prejudice to Nana'selections's right to bring the dispute before any other competent jurisdiction.
